Child Custody* Law
During a divorce or separation it is vital that any children involved are reassured that both parents will continue to love and care for them, despite the fact that they are separating. Issues relating to where and with whom the children will live following the divorce or separation are certain to arise, and often they are dealt with privately by the couple.
However, when emotions are running high it can be very difficult for the couple to reach such an agreement on child custody*. In situations like this, it is often helpful to enlist the services of an experienced child custody* solicitor, who will act as an independent mediator, helping the couple reach an agreement without the need to go to court.
Unfortunately, child custody* disputes cannot always be resolved in this manner; sometimes court is the only option. Child custody* law is contained in the Children Act 1989 and the applications are as follows:
- Residence Order: deals with where the children will live following the separation.
- Contact Order: sets out a pattern of contact between a child and the parent who does not live with them.
- Prohibited Steps Order: Prevents a person from taking a specific "step" in relation to the children, for example preventing them from being permanently removed from the country.
- Specific Issue Order: Allows the court to decide on an issue which relates to the child or children, upon which the separating couple cannot reach an agreement, for example choice of school.
Custody*
The term 'custody' no longer exists as it was replaced in the Children Act 1989 with the term 'parental responsibility'.
The terminology under the Children Act 1989 are:
- Residence - where and with whom the child lives
- Contact - when the child sees the parent who they do not live with
- Parental responsibility means all the rights duties powers responsibilities and authority which by law a parent of a child has in relation to the child and his property.
